Process Serving

Generally speaking, the first step in the litigation process is the serving of a summons and complaint upon an individual or corporation.  Depending on which state you are in, the documents may be referred to by various names; however, the process begins in the same way; the party being sued is notified there is some type of action being taken against them and what the party is suing for.

Delivery of the Documents

Whatever the name of the documents being served on an entity, the papers have to be delivered in some way.

One of the most common ways to deliver a summons and complaint is by using the sheriff in a particular county where the party resides or has a business. For a variety of reasons the attorney or plaintiff will hire an independant individual to "serve" the papers on the defendant. Some of the reasons to hire a process server are shown here:

  • The plaintiff is in a rush to get the papers served.  With all due respect to the local sheriffs, civil papers are not their highest priority, especially in large municpalities. They most often overwhelmed and under staffed.
  • The person being served might evade law enforcement officials when they drive up in a patrol car at 5:00 or 6:00 in the morning.  They know for sure the officials are not there for coffee and donuts.
  • Timing often creates the need for a process server because the person being served may not be at home or at their place of business when the sheriff's department comes knocking.  In many cases the officer will return the documents as not-to-be-found (NTBF).  Another instance may be that the entity being served has to receive the notice by a specified date.
  •  Communication with the process server can be the difference between a good serve or disaster.  The client should tell the server, either by phone, letter, fax or some other means of communication, what the person to be served looks like with as many details as possible.  Knowing the type of vehicle the person drives or any habits of the person could, and often does, make the difference.
  • Choosing an experienced professional can be the difference between a good service or disaster. The client should ask the server such questions as how many years has he/she been in this business and what kind of training or experience he/she has with the type of documents being served.

Service Fees

Generally speaking, our fees start at $50.00 plus expenses.  The specific fee may vary depending on how many attempts need to be made to accomplish the serve.  Mileage is usually the only expense we encounter. If there is a problem with the serve or if there are additional charges to be made, you will be notified prior to incurring those charges.

We make the process as easy as possible to accomplish the serve.  Because of our on-going training and experience, we know how to get the job done in the most efficient and effective manner, thus saving our clients money.
